The revelation from Take-Two’s lawsuit documentation is a two-fold stab in the heart for those, like me, who really just wants this whole game dead already.
Firstly, according to the court documents, it has been pointed out that “[3D Realms/Apogee Ltd.] admits that it has continually worked on the development of the DNF for many years, and continues to do so”
In other words? The original team may be gone but they are still working on The Duke.
Secondly, it has become apparent that Take-Two was actually funding another Duke Nukem game, entitled Duke Begins, which was started in 2007 and canned about the same time 3D Realms went belly up.
Some people are wondering if the second game was part of the deal between the publisher and the developer. Personally I’m wondering what the hell Take-Two were smoking if they thought they could make profit by sinking millions of dollars into Generic FPS #1874635.

I agree with Michael. There’s no point in trying to ressurect Duke. Seeing as Forever took feckin’ 12 years to make, only to get canceled pretty much means no one cares anymore.

@Jens Erik Vaaler, Wait, people still cared this decade?

@Jon Shire, I guess someone must have, seeing as a lot of folks around the net said it was tragic that 3D Realms closed down before they could finish DNF. THe rest of us moved on to more competent developers.
